This policy applies to all domain name registration, renewal, and management services facilitated by Grey Square Private Limited (“Grey Square”, “we”, “us”, or “our”).
1. Facilitation and Agency Role
1.1. Service Description: Grey Square acts as an intermediary and facilitator between the Customer and various accredited Domain Registrars or Registries (e.g., ZISPA for .co.zw domains).
1.2. No Guarantee of Registration: Submission of an application and payment to us does not guarantee that a domain name will be registered. Registration is subject to availability and the policies of the relevant Registry.
1.3. Registry Terms: By requesting a domain through us, you agree to be bound by the terms and conditions of the respective Registry. For .co.zw domains, you expressly agree to the ZISPA Terms and Conditions.
2. Registration Requirements
2.1. Accuracy of Data: You must provide accurate and complete ownership (Registrant) information. Per POTRAZ and ZISPA regulations, the “Domain Owner” must be the actual person or entity intended to own the domain, not Grey Square or a developer.
2.2. Supporting Documents: For local Zimbabwe domains (.co.zw), you may be required to provide a signed application letter on company letterhead and a copy of your National ID or Certificate of Incorporation to satisfy Registry requirements.
2.3. Technical Requirements: We will facilitate the configuration of Name Servers (DNS). If you provide your own Name Servers, they must be authoritative and operational at the time of the request.
3. Fees and Renewals
3.1. Payments: All fees for domain registration or facilitation must be paid in full before we initiate the process with the Registry.
3.2. Renewal Responsibility: While we may send courtesy renewal reminders to your registered email address, it is your ultimate responsibility to ensure that your domain is renewed before its expiry date.
3.3. Failure to Renew: If a domain is not renewed by the expiry date, it may enter a “Grace Period” or “Redemption Period” where significantly higher fees apply, or it may be deleted and made available to the public. Grey Square is not liable for loss of domains due to late payment.
4. Intellectual Property and Disputes
4.1. Warranties: You warrant that the registration of the domain name and the way it is used does not infringe upon the intellectual property rights (trademarks, etc.) of any third party.
4.2. Disputes: Grey Square does not act as an arbiter in domain name disputes. Any disputes regarding the right to a domain name must be resolved between the parties involved or through the Registry’s dispute resolution policy.
5. Transfers
5.1. Incoming Transfers: We will assist in transferring your domain to our management; however, you are responsible for obtaining the EPP/Transfer code from your current provider and ensuring the domain is “unlocked.”
5.2. Outgoing Transfers: You are free to transfer your domain to another provider. We will provide the necessary authorization codes provided all outstanding invoices for our services have been paid in full.
6. Limitation of Liability
6.1. We are not liable for any errors made by the Registry, nor for the loss of a domain name due to Registry bankruptcy, technical failure, or change in national policy.
6.2. In no event shall our liability for domain services exceed the specific facilitation fee paid for that registration.
